Founded in 1896, Adelphi University is a private university located on a 75-acre campus in Garden City, New York. My Right Word: A Failing of Israeli Legal Scholars

In my previous post, I quoted extensively from Howard Grief's responses, detailing legal opinions regarding the issue of whether Israel has internationally-recognized legal rights to the territory of Judea, Samaria and Gaza.

I did so, in part, after obtaining a copy of this article, "Private Claims to Property Rights in the Future Israeli-Palestinian Settlement," by Eyal Benvenisti and Eyal Zamir, which appeared in the American Journal of?International Law, 89, 295-340 (1995) which is quoted by various scholars and appears on required/recommended reading lists at universities.

In discussing the theme of the 'Legal Status of the Territories', p. 305, section 3 (a), the authors, while defining the situation so: "the unique status of the West Bank and Gaza Strip - as territories with no sovereign government - ..." and indicate that Israel's position is one of official non-recognition of these areas as occupied territories, although Israel had undertaken to abide by the "humanitarian provisions" of the Fourth Geneva Convention, they note that

"Israel's unwillingness to acknowledge the applicability of the Fourth Geneva Convention has been rejected by the international community"

They further note that the peace treaty with Jordan of 1994 "reflects the distinct status of the West Bank, outside Jordan's jurisdiction" and that the proclamation of the 'State of Palestine' in 1988

"could not affect the status of the West Bank because this new entity failed to qualify as a state under international law"

They refer to "different legal arguments as to the status of the West Bank and the Gaza Strip" but provide no adequate outline of such although there are a few footnote references but nothing of a firm pro-stance.? Moreover, in their "Historical Background" section, 1, pp. 297-298, despite?clearly stating that

"until 1948, Palestine/Eretz Yisrael was a unified territorial and political unit...long before the Zionist immigration of the twentieth centruy, there was a small Jewish population in Palesagtine/Eretz Yisrael, mainly in Jerusalem, Hebron, Tiberias and Safad (though elsewhere, including the town of Gaza)..."

thyey draw no legal principles or conclusions or even raise conjectures from all that as regards the national rights of Jews to and in Judea, Samaria and Gaza.

Their article, of course, deals with the rights of individuals and does touch of communal rights but no higher in the poitical definitions of an ethnic group.? On p. 311, you can read that there is a premise that

"there is a historical, political and moral link between the status of the property left by Israelis in the West Bank? and the Gaza Strip in 1948 , and the status of property left by Palestinians in Israel at that time"

They quickly aver as to a similarity of circumstances of their legal analyses but do not engage in any discussion that could promote Jewish rights as to the question beyond property owned by individuals.? This is a failing on their part.

Jews do have national rights to the territory beyond elementary individual rights.? The Mandate decision awarded Jews the right, which was not granted to others, defined simply as "non-Jews", to make use of state and waste lands specifically for the right of close settlement on the land and that land was to become the reconstituted Jewish national home.

Law/legal opinion/discussion such as this is unworthy of Israelis, even as academic scholarly researchers.

France: Only 6 veiled women fined since April (AP)

PARIS ? France's interior minister says that since a ban on face-covering Islamic veils took effect in April only six women have been convicted and fined.

Claude Gueant said in an interview with the daily Le Monde published Monday that no woman has been sent to a citizenship class ? another potential punishment.

Controversy surrounded the law. Muslim leaders, most of them opposed to burqa-style veils, say the it stigmatizes all followers of Islam.

Gueant says police cited a total of 237 women but only six were convicted. He expressed surprise that nearly a quarter of the women police questioned had converted to Islam.

Backers say the law is aimed at ensuring France's secular values and gender equality and nipping radical Islam in the bud.

Gadsden Mayor Sherman Guyton said his wish list for 2012 includes more industrial and commercial announcements.

Guyton said more jobs are needed, and he?d like to see more industries locating on city-owned property on Airport Road.

He said the new instrument landing system and other improvements at the Northeast Alabama Regional Airport will help the area, as will a new fire station near the airport.

Guyton also is hopeful for additional retail expansion in Gadsden, in addition to the proposed development at River Trace Golf Course.

Guyton pointed out that Gadsden already is a regional center for medical services with Riverview Regional Medical Center and Gadsden Regional Medical Center.

LAGUNA WOODS, Jennifer Marks: I usually agree with columnist Walter E. Williams, but he needs to stay away from the subject of international trade. He is not an expert on it. In ?China trade fuss ignores facts? [Dec. 27], he debunks the idea that the U.S.-China trade imbalance is harming our economy. His analysis incorrectly lumps together domestic consumer spending on goods with domestic consumer spending on services. He concludes that only a small fraction of this spending goes to China, and, by doing so, he lumps together apples and oranges.

Manufactured products are not consumer services. Of course, most service providers, like doctors, lawyers, accountants, beauticians and cab drivers, are Americans. In every country, service providers are almost always local people. You are not going to hire a hairstylist in China.

A correct analysis would have left out spending on services and calculated Chinese-manufactured goods as a percentage of all goods purchased in the United States. These numbers would not look nearly as rosy. If, as Williams claims, 16 percent of all U.S. purchases of goods and services were manufactured abroad, probably 32 percent of all manufactured goods were made overseas. That would mean that almost one-third of all goods purchased in the United States were made elsewhere. That is a large percentage and one that could harm our country, particularly if those countries do not reciprocate by buying our manufactured goods in return.

China protects and assists its businesses and industries. They make it hard for foreign businesses to operate in their country. For example, China does not allow foreigners to run a company there. An American wanting to open a plant in China must select a Chinese business partner, whether he wants one or not.

The Chinese government supports businesses and industries in China and recognizes that manufacturing prosperity is essential to economic development.

The U.S. government often acts like business is the enemy of the people. Their anti-business attitudes have driven jobs and whole industries out of this country. Just look at how the Obama administration has been persecuting Boeing, one of our more successful companies. They tried to block Boeing from building another airplane plant in another state. Would they prefer that Boeing just pack up and move their operations overseas?

Finally, Williams? editorial fails to mention intellectual property theft, such as pirated CD?s and the theft of patented U.S. technology, which is endemic in China. He also fails to discuss currency manipulation.

MISSION VIEJO, Bill Chase: I am a Walter E. Williams fan; however, I take exception to much of what was in his column on Dec. 27. He references the value of the imports. Of course, the dollar value is low, and labor and all other costs are lower in China. And costs are lower especially if you steal industrial secrets to develop and manufacture products.

Also, comparing dollar figures from 1980 to today without using inflation references is misleading. The bottom line is that China really is a big culprit in our unemployment problems. Sending money borrowed from China back to them in aid money compounds the issue. The Chinese government is not our friend.

6 businesses got bulk of Rome tornado damage

A week after a tornado struck northwest Georgia, an examination of damage has resulted in losses estimated at $1.82 million in the Rome area.

Floyd County Emergency Management Agency Director Scotty Hancock told the Rome News-Tribune that two-thirds of the losses were incurred by six businesses, with none listed as destroyed.

Keith Clark, owner of the West Rome IGA grocery, says he's still assessing damage to his store but says the roof over the shopping center will have to be replaced. He says thousands of dollars worth of food had to be dumped.

Thirty-one other businesses or commercial establishments also sustained losses that are being listed as minor, meaning losses of at least $20,000 were estimated.

Hancock says Floyd County is eligible for assistance through the Small Business Administration.
